United States: CPSIA and Textile Regulations

The United States regulations are governed by the U.S. Consumer Product Safety Commission (CPSC) under the Consumer Product Safety Improvement Act (CPSIA).

Flammability (Children’s Sleepwear Standards):

The U.S. differentiates between general apparel and children’s sleepwear.

General Wearing Apparel:
Must comply with 16 CFR Part 1610 (Standard for the Flammability of Clothing Textiles).

Children’s Sleepwear (0–14 years):
Subject to stricter flammability standards under 16 CFR Parts 1615 & 1616.
Garments must either:

  • Meet defined flame resistance testing requirements, or
  • Be designed to fit snugly according to CPSC sizing specifications.

Tracking and Certification:

Children’s Product Certificate (CPC):
All children’s clothing must be tested at a CPSC-accepted third-party laboratory. A CPC must be issued confirming compliance with all applicable rules.

Tracking Label Requirement:
Each garment must include a permanent tracking label with manufacturer/importer details, batch number, and production information.

Chemical Restrictions:

Strict limits apply to:

  • Lead content (substrate and surface coatings)
  • Phthalates (0.1% limit in accessible plastic components)

Baby clothing must be tested to ensure compliance with CPSIA heavy metal and chemical content limits.

Mechanical Safety:

  • Small parts must not present choking hazards.
  • Snaps, buttons, and trims must pass pull strength testing.
